These Terms and Conditions govern access to and use of Crescent Production services, including our public website, assessment application, training portals, white labeled environments, and administrative tools. By accessing or using any part of the services, you agree to these Terms.

1. Definitions
Crescent Production, we, us, our means Crescent Production and its services.
Services means the website, assessment application, training portals, white labeled portals, dashboards, reports, exports, and administrative tools we provide.
You, your, Customer means the individual user, company, or organization accessing the Services.
Account means a user profile that enables access to gated features of the Services.
Customer Content means content, data, files, assessment inputs, responses, and materials submitted to the Services.
Outputs means generated results such as dashboards, recommendations, implementation guides, proposals, curriculum outlines, reports, ROI modeling outputs, PDFs, and share links.
2. Eligibility and Authority
You represent that you are at least the age of majority in your place of residence and that you have authority to bind your organization when using the Services on behalf of a company.
3. Scope of Services
The Services may include:
- A public marketing website describing offerings and enabling contact requests
- An assessment application that collects inputs and generates findings, recommendations, and financial models
- Training portals that deliver learning content, track usage, and provide reporting
- White labeled environments that present a branded training experience for a Customer
- Administrative tools used to manage accounts, branding settings, and content operations
Service features may evolve over time to improve functionality, security, and performance.
4. Accounts, Access, and Security
4.1 Account creation
Certain features require an Account. You agree to provide accurate information and maintain current Account details.
4.2 Security responsibilities
You agree to safeguard login credentials and limit access to authorized users. You agree to notify us promptly of suspected unauthorized access by emailing info@crescentproduction.com.
4.3 Administrative control
For organizational accounts, designated administrators may manage users, permissions, and access within the Customer environment.
5. Customer Content and Outputs
5.1 Ownership
As between you and Crescent Production, you retain rights to Customer Content you submit.
5.2 License to operate the Services
You grant Crescent Production a limited license to host, process, transmit, and display Customer Content solely to provide, maintain, secure, and improve the Services and to generate Outputs for you.
5.3 Outputs
Outputs are generated from Customer Content and system logic. You may use Outputs within your business for internal planning, training, and operations. Sharing Outputs with third parties remains your responsibility.
5.4 Confidential handling
We treat Customer Content and Outputs as confidential business information and apply access controls consistent with the permission structure of the Services.
6. Intellectual Property
6.1 Our intellectual property
The Services, including software, workflows, templates, prompts, logic, dashboards, interface designs, and proprietary methods remain the intellectual property of Crescent Production.
6.2 Customer branding
Customer logos, trademarks, and brand assets remain the property of the Customer. You grant us permission to display such assets within your white labeled environment to deliver the branded experience.
6.3 Feedback
If you provide feedback, suggestions, or feature requests, you grant us permission to use them to improve the Services without restriction.
7. Acceptable Use
You agree to use the Services in a lawful manner and in a way that supports secure operation. You agree to refrain from:
- Accessing the Services in a way that disrupts performance, integrity, or availability
- Attempting to bypass authentication or authorization controls
- Uploading malware or content designed to compromise systems
- Reverse engineering, copying, or extracting source code from the Services
- Using the Services to process information in violation of applicable privacy laws
- Using the Services to infringe intellectual property rights of others
- Misrepresenting Outputs as professional legal, medical, tax, or regulated financial advice
We may suspend access when usage creates security risk, legal exposure, or operational harm.
8. Privacy
Our collection and use of personal information is governed by our Privacy Policy dated February 15, 2026. By using the Services, you agree to that policy.
9. Billing, Fees, and Payments
9.1 Fees
Fees may apply for subscriptions, portal access, white labeling, hosting, usage, professional services, implementation, and ongoing support, depending on your plan.
9.2 Payment terms
Invoices are payable according to the terms stated on the invoice or agreed service order. Continued access to paid features may depend on current payment status.
9.3 Taxes
You are responsible for applicable taxes, duties, and government charges associated with your purchase, excluding taxes on our income.
9.4 Refunds
Refund handling depends on the service type and scope already delivered. Professional services and implementation work typically involve time based delivery and milestone completion.
10. Service Availability and Support
We aim to provide reliable access, security, and performance. Planned maintenance may occur to support updates and stability. Support channels and response expectations depend on the plan level.
11. Disclaimers Related to Assessments and ROI Outputs
11.1 Decision support
Assessment results and Outputs provide structured decision support based on user inputs, assumptions, and modeling logic.
11.2 Estimates
ROI, payback, cost, and value ranges reflect estimates. Real outcomes depend on execution quality, adoption, operating conditions, market factors, and leadership follow through.
11.3 Professional judgment
You are responsible for validating assumptions and using appropriate professional judgment before acting on Outputs.
12. Limitation of Liability
To the maximum extent permitted by law:
- Crescent Production liability arising from the Services is limited to the fees you paid to Crescent Production for the Services during the three months immediately preceding the event giving rise to the claim.
- Crescent Production is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of data, or business interruption, even if advised of the possibility.
Some jurisdictions limit the enforceability of these exclusions, in which case they apply to the greatest extent permitted.
13. Indemnification
You agree to indemnify and hold Crescent Production harmless from claims, damages, liabilities, and expenses arising from:
- Your use of the Services in violation of these Terms
- Customer Content you submit that infringes rights of a third party
- Your distribution or reliance on Outputs in a way that creates third party claims
14. Suspension and Termination
14.1 Suspension
We may suspend access to protect security, investigate misuse, comply with legal requirements, or address risk to the platform.
14.2 Termination by you
You may discontinue use at any time. Subscription cancellations take effect according to your plan billing cycle.
14.3 Termination by us
We may terminate access for material breach of these Terms, repeated misuse, or ongoing security risk.
14.4 Data access after termination
After termination, access to the platform may end. Data export options may be available depending on plan scope and operational constraints.
15. Changes to the Services and Terms
We may update the Services and these Terms to reflect improvements, security changes, and legal requirements. Updated Terms become effective upon posting. Continued use of the Services after updates indicates acceptance.
16. Governing Law and Venue
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta. You agree that courts located in Calgary, Alberta have exclusive jurisdiction over disputes arising from these Terms or the Services.
